Terms of Service

1. Definitions

• "Service" — the Maunitoring SaaS platform, including the dashboard, API, and agent software
• "Customer" — the organization or individual subscribing to the Service
• "User" — any person accessing the Service on behalf of the Customer
• "Data" — all logs, events, and security data processed through the Service

2. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old, have the authority to bind your organization, and agree to these Terms. If you do not agree, you must not use the Service.

3. Service Description

Maunitoring provides a cloud-based security information and event management (SIEM) platform including:

• Real-time log collection and analysis from Windows and Linux agents
• AI-powered alert triage and SOC automation
• Network monitoring, uptime checks, and threat intelligence
• Compliance reporting and audit logging
• Team collaboration features including on-call scheduling and war room

4. Subscription & Payment

Plans

The Service is offered under tiered subscription plans (Starter, Pro, Enterprise). Plan details including pricing and feature limits are published on our website and may be updated with 30 days' notice.

Billing

• Subscriptions are billed monthly or annually in advance
• All prices are exclusive of VAT unless stated otherwise
• Payment is due on the subscription renewal date
• Failed payments may result in service suspension after a 7-day grace period

Free Trial

We may offer a free trial period. At the end of the trial, the Service will require a paid subscription to continue. We reserve the right to modify or end trial offers at any time.

Cancellation & Refunds

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial billing periods, except where required by law

5. Acceptable Use

You agree not to use the Service to:

• Monitor systems or networks you do not own or have explicit permission to monitor
• Engage in illegal surveillance or privacy violations
• Attempt to compromise the security of the platform or other customers
• Resell or sublicense the Service without written consent
• Generate excessive API requests that degrade service performance for others
• Store or process data that violates applicable laws or third-party rights

6. Your Data

You retain full ownership of all data you submit to the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service.

We do not sell, share, or use your security data for any purpose other than delivering the Service. See our Privacy Policy for full details.

7. Data Security & Availability

We implement industry-standard security measures to protect your data. However, no system is 100% secure. We are not liable for security breaches beyond our reasonable control.

We target 99.5% monthly uptime for paid plans. Scheduled maintenance windows are communicated at least 48 hours in advance via the status page and email.

8. Intellectual Property

The Maunitoring platform, including its software, design, and documentation, is our exclusive property. These Terms do not grant you any intellectual property rights in the Service beyond the limited right to use it as described herein.

You retain all rights to your data and any content you create using the Service.

9. Confidentiality

Both parties agree to keep confidential any non-public information received from the other party. This obligation survives termination of the agreement for a period of 3 years.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim

Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.

11. Termination

We may suspend or terminate your account immediately if you breach these Terms. Upon termination:

• Your access to the Service will be revoked
• Your data will be retained for 30 days, after which it will be permanently deleted
• You may request an export of your data before deletion

12. Changes to the Service

We reserve the right to modify, update, or discontinue features of the Service with reasonable notice. Material changes that affect core functionality will be communicated at least 30 days in advance.

13. Governing Law & Disputes

These Terms are governed by the laws of the European Union and, where applicable, the laws of France. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Luxembourg, unless mandatory local law requires otherwise.
